You agree to use the Site for lawful purposes only. You are prohibited from:

• Impersonating or attempting to impersonate Goodbye Yesterday, LLC, a Goodbye Yesterday, LLC employee, another user, or any other person or entity.
• Using any manual or automated means to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent.
•  You may view, copy or print pages from the Site solely for personal, non-commercial purposes. You may not otherwise use, modify, copy, print, display, reproduce, distribute or publish any information from the Web Site without the express, prior, written consent of the Company. 

5. Online Account Access

 For certain features available through the Site, you are able to create a Goodbye Yesterday account (“User Account”). For self-enrollment, you must provide Account-specific information to authenticate yourself (i.e. Account owner name, address, email address, phone number, and password). We use reasonable precautions to protect the privacy of your User Account information by utiliz. Accordingly, your UserID, password and User Account information are encrypted using an SSL connection and are not expected to be read in an intelligible form as they travel to the Web Site. You, however, are ultimately responsible for protecting your UserID, password and User Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You are required to take reasonable precautions to safeguard your UserID and password. You agree to never leave your computer unattended while using the Online Service and to always exit the Online Service by clicking on “Log Out.” You also agree to immediately notify the Company of any unauthorized use of your UserID, password and/or User Account, or any other breach of security by notifying us via Contact Us. You are solely responsible for any activity that occurs with respect to your User Account and UserID. While we provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the Internet is secure, or that such transmissions are free from delay, error, interception or interruption.  You authorize the Company to rely on your UserID and password to identify you when you use your User Account, and as signature authorization for any payment made using the User Account. You acknowledge and agree that you are responsible for all payments you make using your User Account. You also acknowledge and agree that if you permit another person or persons to use the User Account or give them your UserID and/or password, you are responsible for any payment that person makes to your User Account, even if the person exceeds your authorization.   Company reserves the right to terminate your User Account for any reason including inactivity and at any time without notice to you. You have the right to terminate your use of the User Account by writing to the Company at the address provided at the end of these terms. Any termination of your use of the User Account, whether by you or the Company, will not affect any of your or the Company’s rights and obligations under these Terms that have arisen prior to the effective date of such termination. 

6. Product Information

We strive to ensure that the information on our Site is accurate, complete, and current. However, there may be instances where information about a product may be inaccurate or incomplete. We reserve the right to correct any errors or omissions and to change or update information at any time without prior notice.

7. Orders and Payment

By placing an order through our Site, you represent and warrant that you are legally capable of entering into binding contracts. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason.

Payment for all products must be made by credit or debit card or other payment method specified on the Site. By submitting payment information, you authorize us to charge the payment method you provide.

8. Shipping and Delivery

Shipping and delivery times are estimates only and are not guaranteed. We are not liable for any delays in shipping or delivery. Risk of loss and title for products pass to you upon delivery.

10. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Goodbye Yesterday, LLC or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

11. Disclaimer of Warranties

The Site and all content, products, and services provided on the Site are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Goodbye Yesterday, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Site; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

13. Indemnification

You agree to indemnify, defend, and hold harmless Goodbye Yesterday, LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Hawaii for the resolution of any disputes arising out of or relating to these Terms or the Site.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and Returns and Exchanges policy, constitute the entire agreement between you and Goodbye Yesterday, LLC regarding the use of the Site and supersede any prior agreements or understandings, whether written or oral.
